("Agreement") constitute a legal agreement between you and
Brandon Cole ("Cole"). If you do not agree to these terms
and conditions, please do not use this web site. Please read this
entire agreement carefully before you continue to use this web site, as
entering and viewing its contents signifies that you understand these
terms and agree to be governed by them.
This
web site is owned and operated by Cole. All of the content displayed
or featured on this web site, including, but not limited to images,
photographs, graphics, text, logos, and illustrations
("Content"), are owned exclusively by Cole. All elements
of this web site, including, but not limited to, the general design and
the Content, are protected by Copyright, moral rights, trademarks, and all
other laws protecting intellectual property rights including contract law
pursuant to this Agreement.
Without
exception, no Content may be copied, distributed, transmitted, reproduced,
republished, uploaded, modified, archived, sampled, posted in any way, in
whole or in part, without the express prior written authorization of Cole.
You may view the Content on any single computer monitor for your personal,
non-commercial use only, provided you keep intact, without change, all
copyright and other proprietary notices. Modification of the Content
or use of the Content for any other purpose is a violation of Cole's
copyright and other proprietary rights. You shall indemnify Cole and
his affiliates against all losses, expenses, costs, or damages, including
attorneys' fee, incurred by any or all of them as a result of your breach
of the terms of this Agreement or your unauthorized use of the Content and
related rights.
THE
PHOTOGRAPHIC IMAGES ON THIS WEB SITE ARE NOT FREE!
We are happy, of course, to license usage rights for a negotiable fee.
Our fees are very competitive, and our service excellent. The
quality of the photography- we hope you agree- speaks for itself. THESE
PHOTOS ARE NOT MICROSTOCK! As traditional stock photography, image use is subject to the
issuance and payment of an image use licensing agreement. THESE
PHOTOS ARE NOT IN THE PUBLIC DOMAIN. All
Content is the exclusive property of Brandon Cole, all rights are
reserved, and any unauthorized use whatsoever is an infringement of
US and international copyright and is punishable by law. Image theft
is a serious offense, and as we've registered this site's images with the
Copyright Office, we will pursue any infringement to the fullest extent of
the law. In the event an infringement is discovered, you will be
notified and invoiced the industry standard TRIPLE FEE for unauthorized
usage and/or prosecuted for copyright infringement in US Federal Court
where you will be subject to a fine of US $150,000 statutory damages as
well as all court costs and attorneys' fees. By entering this site
you are agreeing to be bound by the terms of this Agreement.
